Empirical Analysis of Arbitration Dynamics in Cross-Border Insolvency: The Role of Lex Mercatoria in Asset Recovery

This study examines the integration of lex mercatoria principles in international arbitration cases concerning cross-border insolvency. Using a mixed-methods approach, we analyzed 50 arbitration awards from 2024-2026 where lex mercatoria was invoked. Our findings reveal significant variations in asset recovery outcomes, suggesting that standardized guidelines could mitigate jurisdictional discrepancies. These insights contribute to ongoing debates on harmonizing international trade laws and underscore the importance of adaptable legal frameworks in bankruptcy arbitration. This research advances both theoretical understanding and practical application of arbitration laws in a globalized economy.
